Consumer Dispute Resolution

The Consumer Protection Act, 2019 (CPA) as amended and updated is a benevolent social legislation for protection of the rights of the consumers. It provides means to protect consumers from getting cheated or harassed by the suppliers/ manufacturer or service provider. CPA establishes three-tier quasi-judicial system at National, State and District levels for resolving consumer disputes. Consumer can file complaint before the appropriate forum depending upon the cost and compensation claimed. A “Consumer dispute” means a person against whom a complaint has been made, denies or disputes the allegations contained in the complaint, against defected, spurious goods and services, unfair trade practices, any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by or under any law for the time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service etc.

How to file a consumer complaint?

  • Notice to the seller / manufacturer / provider about the deficiency / defects or spurious goods and services.
  • Drafting a complaint with:

    Complainant’s and opposite party’s name, address, description.

    Cause of action with date, time, and venue.

    Relief claimed.

    Signature and verification.

  • Attach relevant documents like bills, warranty, guarantee, and a copy of the complaint and notice sent to the concerned party.
  • Identify the jurisdiction of the forum.
  • Submit the complaint after paying the requisite fees.
  • Submit the complaint along with an affidavit to the appropriate forum.

Limitation period to file a case
