Introduction:

Indian Succession Act, 1925 defined ‘Will’ as - ‘the legal declaration of the intention of the testator with respect to his property which he desires to be carried into effect after his death. A will must be signed or thumb-marked by the testator, and must be attested by at least two independent and uninterested witnesses who must sign as witnesses in each other’s presence and in the presence of the testator. A will does not require registration. However it may be registered by the testator during his lifetime.

Will May Contain

There is no specified format prescribed for a ‘Will’ in India. However, certain key elements are essential for an effective will, as follows:

  • Testator’s details like Name, Age, Address, etc.
  • The testator must be of sound mind and be a major, above 18 years of age.
  • Listing of assets – must include a list of all assets and valuable possessions owned by the testator.
  • The will must be made with the free consent of the testator. Any part of the will made by force, fraud, coercion, or threat shall be invalid and unenforceable by law.
  • Dividing the assets – the testator must clearly and unambiguously state how the assets will be divided to avoid unnecessary disputes when the will is enacted.
  • If the testator wishes to bestow any share upon a minor, they must appoint a guardian to manage the minor’s estate/share.
  • Executor – the testator may also appoint a person who will execute the will after their death.
  • Signatures of the witnesses and the testator.
